KinderWorld worker accused of crashing van into another vehicle

A Harris County woman is suing a Houston daycare worker and her employer after allegedly being hit by a KinderWorld van.

Claudia Rosibel Torres filed the complaint against Izathnunisa Begum Moosavi and her employer, Wisdom Enterprises, on Sept. 21 in Harris County District Court.

 

According to the lawsuit, Torres was a passenger in a Toyota Sienna that was hit by Moosavi in February 2009. Moosavi was allegedly driving a Ford van when she changed lanes without warning and crashed into the Sienna.

 

Torres claims Moosavi was driving the van on behalf of her employer, Wisdom Enterprises, which operates a daycare under the name KinderWorld. 

 

Torres accuses Moosavi of negligence for failing to use brakes or other evasive actions to avoid the collision, failing to control the vehicle and its speed and failing to safely change lanes. 

 

Torres argues Moosavi was an incompetent, reckless driver unfit to operate a vehicle. Because KinderWorld gave its employee permission to drive, Torres says the company is liable for the Moosavi’s alleged negligence.

 

Torres seeks actual damages from both defendants to compensate for medical expenses, lost wages, pain and suffering, disability, loss of household services and property damage to the Sienna.

 

Attorney Jorge L. Gomez of the Gomez Law Firm in Houston is representing Torres. She demands a jury trial.
